importing

when i import dead npc (checked) all the enemies i have killed and phoenix who i kidnapp are back to life (and phoenix in his throne back again)...and i did test the oppossite if dead npc was unckecked but same thing happens

If the NPC is not dead or in a cage at the time of import, they will be respawned at their original location even with the option checked.

yes i did those 2 things too...in one senario i killed him and the body wasnt there...and in other senario i locked him in a cage and after importing he was not there

and if i kill someone and import with checked npc the corpse will have to be still there right?

No matter what you do an import will despawn the NPC. But they should not respawn unless they were alive and free, or if you uncheck the option. And the corpse shouldn't matter once they're dead, the flag has already been triggered at that point and the body is irrelevant.

If they're respawning with the option checked and they were 100% dead or caged at a the time of import, I'd look into any mods you might have, as that shouldn't happen in vanilla.
